NATIONAL ENVIRONMENTAL PROTECTION EFFLUENT LIMITATION REGULATIONS

Regulation · Water

Regulations set maximum limits for pollutants in industrial and domestic waste discharged into water bodies to protect aquatic environments. They target industrial facilities, municipalities, and environmental agencies. This prevents water pollution and safeguards ecosystems for downstream users.

What Is This Policy?

Regulations setting maximum permissible concentrations of pollutants in industrial and domestic liquid waste discharged into Nigerian water bodies, protecting freshwater, coastal, and marine environments from contamination.

Who Does It Target?

Industrial facilities discharging effluent to water bodies or municipal sewers Municipalities and sanitation authorities NESREA as the primary enforcement authority State environmental agencies

What Does It Aim to Achieve?

To prevent water pollution from industrial and municipal effluent, protect aquatic ecosystems and downstream water users, and establish a national baseline of water quality protection.

Key Features

Numerical Effluent Standards: Sets specific limits for pH, BOD, COD, suspended solids, heavy metals, and other parameters. Discharge Permit: Industries must obtain a discharge permit from NESREA specifying compliance requirements. Monitoring Programme: Permit holders must sample and analyse effluent regularly and report results. Pre-Treatment Requirements: Dischargers must treat effluent to meet standards before release. Penalties: Exceeding prescribed limits or discharging without a permit attracts fines and prosecution.

Current Status

In force. Enforced by NESREA through industrial inspections and water quality monitoring, with violating facilities subject to administrative penalties and criminal prosecution.

Apply for a discharge permit from NESREA Install and maintain effluent monitoring equipment Submit monitoring reports according to the permit schedule Application method: NESREA headquarters, Abuja, and zonal offices

Important Terms

Permits are subject to annual review Exceeding a single effluent limit constitutes an offence Industrial expansion affecting effluent volumes requires permit variation

Legal Framework

Issued under the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act 2007 (NESREA Act), which empowers NESREA to make regulations on environmental standards. Operates alongside the Environmental Impact Assessment Act 1992, the 1999 Constitution Section 20 on environmental obligations, and relevant international environmental conventions ratified by Nigeria. Draws on the Federal Environmental Protection Agency effluent limitation standards, WHO water quality guidelines, and the National Water Policy for protection of Nigeria's water resources.
