NATIONAL ENVIRONMENTAL PROTECTION POLLUTION ABATEMENT IN INDUSTRIES AND FACILITIES GENERATING WASTES REGULATIONS
Regulation · Environment
Regulations establish minimum standards for controlling pollution from industries and waste-generating facilities. They target manufacturing plants, hospitals, mining operations, and enforcement bodies. The aim is to promote best practices and protect worker health and the environment.
What Is This Policy?
Regulations setting minimum standards for the control of pollution generated by industries and waste-producing facilities, prescribing limits for liquid effluent discharge, air emissions, solid waste disposal, and the handling of hazardous materials.
Who Does It Target?
Manufacturing industries, chemical plants, and food processing facilities Hospitals and health institutions generating clinical waste Mining operations and oil and gas facilities NESREA as the enforcement authority
What Does It Aim to Achieve?
To compel industrial operators to adopt best available practices for waste minimisation and pollution control, protect worker health and the surrounding environment, and establish a baseline of environmental performance.
Key Features
Effluent Discharge Limits: Sets maximum concentrations of pollutants permissible in liquid waste discharged to water bodies. Air Emission Standards: Prescribes limits for particulate matter, sulphur dioxide, nitrogen oxides, and other pollutants. Waste Inventory: Industries must maintain and submit inventories of wastes generated and disposed of. Hazardous Waste Management: Requires segregation, labelling, and approved disposal of hazardous wastes. Environmental Audit: Qualifying facilities must conduct periodic environmental audits and submit reports.
Current Status
In force. Enforced by NESREA through regular industrial facility inspections, environmental audits, and prosecution of operators exceeding prescribed pollution limits.
Facilities must apply for permits from NESREA specifying waste streams and control measures Submit annual environmental compliance reports Allow NESREA inspectors access for compliance verification Application method: NESREA headquarters, Abuja, and zonal offices
Important Terms
Exceeding prescribed limits is an offence Failure to submit required reports attracts administrative sanctions Persistent non-compliance leads to facility closure orders

Legal Framework
Issued under the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act 2007 (NESREA Act), which empowers NESREA to make regulations on environmental standards. Operates alongside the Environmental Impact Assessment Act 1992, the 1999 Constitution Section 20 on environmental obligations, and relevant international environmental conventions ratified by Nigeria. Draws on WHO ambient air quality guidelines, the Basel Convention provisions, the Factories Act, and the National Water Policy for industrial pollution control standards.
