Important Terms

Term 1-Ex-Parte Orders Ex-parte orders are court directives issued without hearing from the other party in a case. While they are sometimes necessary in urgent matters (for example, to prevent irreparable harm before the other party can be heard), they have often been misused in Nigeria to gain unfair advantage. The reform policy seeks to regulate their use, ensuring they are granted only in exceptional circumstances and subject to stricter judicial scrutiny. This protects fairness and prevents abuse of judicial discretion. Term 2- Conflicting Judgments Conflicting judgments occur when courts of equal jurisdiction issue contradictory rulings on similar cases. This undermines the credibility of the judiciary and creates confusion in the legal system. The reform policy emphasizes consistency by strengthening appellate oversight, improving judicial training, and introducing mechanisms to harmonize decisions.
