NATIONAL ENVIRONMENTAL NOISE STANDARDS AND CONTROL REGULATIONS 2009

Regulation · Environment

Regulations establish maximum noise levels for different zones in Nigeria and procedures to control pollution from industrial, commercial, and transport sources. They target factories, entertainment venues, and vehicle owners to enforce these standards. This protects public health by reducing noise-related stress and disturbances.

What Is This Policy?

These Regulations establish maximum permissible noise levels for different land use zones across Nigeria and set out procedures for controlling noise pollution from industrial, commercial, social, and transport sources.

Who Does It Target?

Industrial facilities, factories, and construction sites Operators of public entertainment venues and places of worship Motor vehicle and transport equipment owners

What Does It Aim to Achieve?

To protect the health and quality of life of all Nigerians by reducing noise pollution from industrial and commercial activities to levels that do not cause hearing impairment, stress, or unreasonable community disturbance.

Key Features

Zone-Based Noise Limits: Prescribes maximum permissible noise levels in decibels for industrial, commercial, and residential zones Nighttime Restrictions: Sets stricter noise limits during nighttime hours to protect the right to sleep and rest Construction Noise Controls: Requires mitigation measures such as noise barriers and restricted working hours at construction sites near sensitive areas Vehicle Noise Limits: Sets maximum permissible noise emission levels for motor vehicles and other powered transport equipment Monitoring and Enforcement: Authorises NESREA to conduct noise level measurements and impose fines, stop orders, and other sanctions for violations

Current Status

Rollout Stage: Active enforcement by NESREA and state environmental protection agencies Coverage: Nationwide Funding: Federal government budget through NESREA

How to Access

Industries and businesses must ensure their operations do not exceed the noise limits for their zone. Noise impact assessment as part of the Environmental Impact Assessment for new industrial or commercial projects Installation of approved noise abatement equipment where operations exceed zone limits Compliance reporting to NESREA on request or as required by the facility's operating permit Application method: NESREA headquarters, Abuja, and state environmental offices

Important Terms

Violating noise limits attracts fines calculated on a daily basis for each day the offence continues Persistent non-compliance may result in facility closure orders issued by NESREA
