National Oil Spill Detection and Response Agency (NOSDRA) Act, 2006

Act · Petroleum & Energy

Policy date: 2026-03-04

An Act establishes the National Oil Spill Detection and Response Agency. This body coordinates the detection, containment, and cleanup of oil spills from all petroleum operations nationwide. It holds operators liable and enforces environmental restoration obligations across the country.

What Is This Policy?

The NOSDRA Act established the National Oil Spill Detection and Response Agency — Nigeria's dedicated federal body responsible for coordinating detection, containment, and cleanup of oil spills from petroleum operations nationwide, with authority to hold operators liable and enforce environmental restoration obligations.

Who Does It Target?

Upstream, midstream, and downstream petroleum operators including IOCs (Shell, TotalEnergies, Chevron, ExxonMobil) and indigenous companies (NPDC, SEPLAT) Pipeline operators and crude oil transport companies Niger Delta communities and coastal populations directly impacted by oil spills Federal, State, and LGA authorities in oil-producing regions Environmental enforcement agencies: NESREA, DPR (now NUPRC), and State Environmental Protection Agencies

What Does It Aim to Achieve?

Establish a coordinated, rapid national response system for oil spill detection and cleanup across all petroleum sector operations Hold polluting operators financially liable for spill cleanup, remediation, and affected community compensation Build Nigeria's national capacity for oil spill preparedness in compliance with OPRC 1990 and other international conventions Protect Nigeria's biodiversity, water resources, and affected communities from ongoing petroleum pollution

Key Features

Mandatory Reporting: All oil spill incidents — regardless of volume — must be reported to NOSDRA within 24 hours of occurrence; failure attracts severe penalties Polluter-Pays Principle: Oil companies bear full financial responsibility for spill cleanup, remediation, and community restitution costs Joint Investigation Visits (JIV): NOSDRA leads multi-stakeholder JIVs with NUPRC, operators, and community representatives to assess spill causes and volumes National Oil Spill Contingency Plan (NOSCP): NOSDRA administers Nigeria's national emergency oil spill response plan under the OPRC Convention Monitoring Drones & Remote Sensing: NOSDRA deploys satellite imagery, aerial surveillance, and automated detection technologies across the Niger Delta pipeline network Community Participation: Host communities and NGOs participate in JIV panels and spill assessment processes ensuring independent verification

Current Status

The Act is in force as the legal establishment of the National Oil Spill Detection and Response Agency, enabling ongoing coordination of oil spill responses since 2006.

Legal Framework

The NOSDRA Act 2006 is the primary legislation establishing the Agency. It operates alongside the Petroleum Industry Act 2021 (which governs upstream operations), the Oil Pipelines Act, and the Environmental Impact Assessment Act 1992. NOSDRA's authority is supported by the National Environmental (Petroleum and Petroleum Products) Regulations and aligns with the International Convention on Oil Pollution Preparedness, Response and Co-operation (OPRC).
