Legal Framework
The Lawful Interception of Communications Regulations 2019 are issued under the Nigerian Communications Act 2003 and the National Security Agencies Act. They operate alongside the Cybercrimes (Prohibition, Prevention, etc.) Act 2015, the Data Protection Act 2023, and the 1999 Constitution (Section 37 — right to privacy, balanced against national security). They align with the European Telecommunications Standards Institute (ETSI) Lawful Interception standards and international human rights law principles on surveillance from the UN Special Rapporteur on Privacy.
